General Information

This Privacy Notice details important information regarding the use and disclosure of User information collected through the PromapMe Services from both the mobile and web interfaces. The use of the PromapMe Services and any personal information used by the PromapMe Services remains subject to the legal obligations and regulations.

PromapMe services are permission-based and users (employees) share location information only with their fleet/mobile staff manager. PromapMe users will be viewed only during their working hours. The location-sharing can easily be turned on and off at any time on an employee-by-employee basis, for a employee category or for all connections at once.

We advise that you visit this page regularly to stay informed of any changes. Your personal information will only be used in the manner described in the Privacy Notice in effect when we received that personal information. The PromapMe Services are hosted in the European Union. If you are using the PromapMe Services from another region with laws governing data collection and use that may differ from European Union laws, please note that your company and employees’ data will be handled as per the European Union laws.

Location Information Disclosures and Consents

Disclosures.

The PromapMe services allow the authorized mobile resources’ supervisor to see where the employees are located using real-time location information. PromapMe collects, maintains, uses, and displays the real-time geographic location of their mobile devices (“location data”). Please note that this real-time location tracking is active in the designated working periods as long as the PromapMe application is running on your staff mobile devices.

Your Location Information.

In registering for the UmapMe Services, you have agreed and consented:

  1. a. To PromapMe collection, use, maintenance, and display of your employees’ location data to provide all of the services, features, and functionality found within PromapMe;
  2. To the disclosure and display of your location data to your UmapMe connections and UmapMe third-party partners, contractors, and successors, and in accordance with this Privacy Notice;
  3. b. To the disclosure and display of your location data to PromapMe third-party partners, contractors, and successors, and in accordance with this Privacy Notice;

Denial of Consent will not affect your regular phone service but will prevent you from getting the location functions of the PromapMe Service.

End User Privacy Controls.

Your company’s employees should be informed of the conditions under which there are geolocalized.

By law, you are required to inform your employees and – depending on the countries – obtain their written consent to be constantly located during their working hours.

Typically in France, the CNIL (Commission Nationale de l’Informatique et des Libertes) is strictly supervising the professional usage of geolocation systems for fleet management purposes. The “simplified norm #51” allows the declaration of geolocation systems either by public or private companies in their mobile employee’s vehicules for the following purposes:

  • Respect of a legal obligation or regulation
  • Tracking and invoicing for the transportation of persons or goods,
  • Employee’s, goods’ or vehicle’s safety
  • Means’ optimization
  • Resources allocation optimization for spread out services, typically for emergency interventions
  • Work time monitoring

This data can be logged and archived for a 2-month period and can be extended up to 1 year in some specific cases (work time monitoring, round optimization). The employees or their representatives should be informed prior to the system implementation. The concerned information is:

  • Employee’s Identification: first name, last name, professional contact information and reference number, vehicle plate number.
  • Employees’ itineraries information: real-time location information from a mobile positioning application, position history.
  • Additional information about the vehicle usage: speed, covered distance, duration of the vehicle usage, driving duration, number of stops.

The persons authorized to receive this data are

  • the fleet managers planning, synchronizing and tracking the interventions,
  • the people in charge of the security of the persons or goods transported,
  • If need be, the human resources manager

Employee information and access rights

  • The employees’ representatives must be informed and consulted prior to installing the geolocation system
  • Each employee must be informed individually prior to installing the geolocation system
  • This information is about the treatment goal, the categories of the location data handled, the duration of the data conservation, the people receiving this data, the possibility to have an access, correction and opposition right and the way to use it
  • The employees should be able to deactivate the geolocation function outside of their working hours

The Information PromapMe Collects

  • User Provided Registration Information:
  • Subscription information includes certain “personally identifiable” information (such as name, email address, potentially phone number, etc.)

  • Location Information:
  • PromapMe receives Location Information from the Global Positioning System or the Cellid of the service provider’s network.

  • Cookies, Persistent File Information:
  • When you visit the PromapMe Services, we may send one or more cookies to your computer. PromapMe uses both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the PromapMe Services. Persistent cookies can be removed. Please review your web browser “Help” file to learn the proper way to modify your cookie settings.

  • Log File Information:
  • When you use the PromapMe Services, our servers automatically record certain information, such as a mobile device identification number and device identifier, your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed, the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

The Way PromapMe Uses Information

  • PromapMe uses your personally identifiable information and your Location Information to operate, maintain, and provide you with the features and functionality of the PromapMe Services.
  • PromapMe uses your personally identifiable information, your Location Information, and certain non-personally-identifiable information (such as anonymous User usage data, cookies data, browser type, clickstream data, etc.) to improve the quality and design of the PromapMe Services and to create new features, functionality, and services by storing, tracking, and analyzing User preferences and trends.
  • PromapMe uses cookies, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the PromapMe Services; (b) provide custom and personalized content and information and (c) monitor aggregate metrics such as total number of visitors, pages viewed, etc. PromapMe does not combine cookie, clear-gif, or log file-based information with personally identifiable information.
  • PromapMe does not use personally identifiable information or Location Information to send commercial or marketing.
  • We may use your email address or mobile number at any time and without further consent for non-marketing or administrative purposes such as notifying you of major PromapMe Services’ changes, for customer service purposes, and to send privacy or security related notices.

When PromapMe Discloses Information

  • PromapMe does not share your personally identifiable information or Location Information with other, third-party companies for their commercial or marketing use without your express consent or unless you have opted-in to be part of a specific program or feature in accordance with the consent procedures described in this Privacy Notice.
  • PromapMe may release personally identifiable information, Location Information, or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with laws or respond to a court order, subpoena, or search warrant.

Your Choices

You may update, correct, or delete your employees’ privacy preferences and profile information at any time by going to the PromapMe web site from your PC or mobile web site from your phone.

To protect your employees’ privacy and security, we take reasonable steps to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. We do not maintain Location Information history.

PromapMe uses commercially reasonable physical, managerial, and technical safeguards. We cannot, however, ensure or warrant the security of any information that PromapMe receives on your behalf to operate the services or that you transmit to PromapMe, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical, or managerial safeguards.

This geolocation system without any specific GPS tracker is aiming to locate the employees rather than their vehicle.
